These Terms of Service govern your use of the services provided by Scalefy LLC. By engaging our services or submitting information through our website you agree to be bound by these terms.

These terms apply to all services offered by Scalefy LLC including website design and hosting, SMS lead notification and automation systems, lead generation and follow-up systems, and review automation services.

Section 2: Services

Scalefy LLC provides the following services to blue collar businesses across the United States:

  • Website design and hosting including mobile-optimized websites with lead capture forms and automated lead notifications
  • SMS lead notification systems including speed-to-lead SMS, automated follow-up sequences, and missed call text-back
  • Facebook and Instagram lead generation ad campaign setup and management
  • Automated review request systems triggered after completed jobs

All services are delivered subject to a separate written service agreement executed between Scalefy LLC and the client. These Terms of Service apply broadly to all interactions with Scalefy LLC and do not replace or supersede the terms of any individual service agreement. In the event of a conflict between these Terms of Service and a signed service agreement, the signed service agreement controls.

Section 3: SMS Terms

Scalefy LLC operates SMS communication systems as part of its marketing and automation services. The following terms apply to all SMS communications sent by or through Scalefy LLC:

  • To opt out of SMS messages at any time reply STOP to any message. You will receive one confirmation message and no further messages will be sent.
  • To request help or customer care information reply HELP to any message or contact us directly at [email protected] or [INSERT BUSINESS PHONE NUMBER].
  • Message and data rates may apply to all SMS messages sent and received.
  • Message frequency varies depending on the nature of your inquiry and the services being provided.
  • SMS opt-in consent is never shared with or sold to third parties for marketing purposes.

Section 4: Payment Terms

All fees charged by Scalefy LLC are denominated in United States Dollars. Payment terms and amounts for specific services are outlined in the individual service agreement executed between Scalefy LLC and the client.

General payment terms that apply across all service agreements:

  • All invoices are due within the timeframe specified in the applicable service agreement
  • Payments not received within 7 days of the invoice due date will incur a late fee of $25 for every 7 days unpaid thereafter
  • Outstanding balances remaining beyond 30 days from the original invoice date will accrue interest at 1.5% per month
  • Scalefy LLC reserves the right to pause or suspend all services including active ad campaigns, SMS automations, and website hosting until any outstanding balance is paid in full
  • Clients agree not to initiate chargebacks or payment disputes for services rendered. Unjustified chargebacks will result in a $150 dispute handling fee in addition to the original balance owed

Section 5: Limitation of Liability

Scalefy LLC provides all services in good faith and to the best of its ability. However the following limitations apply:

  • Scalefy LLC is not liable for any lost revenue, missed leads, or business interruptions resulting from Meta platform outages, ad account restrictions, SMS carrier filtering, Twilio service disruptions, or any technical failures outside of Scalefy LLC's direct control.
  • Scalefy LLC does not guarantee specific lead volumes, booking rates, revenue outcomes, or business growth as a result of any service provided. Results depend on factors outside of Scalefy LLC's control including market conditions, client responsiveness, ad spend levels, and client sales ability.
  • The total liability of Scalefy LLC under any claim arising from services provided shall not exceed the total fees paid by the client to Scalefy LLC in the 30 days immediately preceding the date the claim is made.

Section 6: Governing Law

These Terms of Service and all matters arising from them shall be governed by and construed in accordance with the laws of the State of Arizona without regard to conflict of law principles. Any disputes arising under these terms that cannot be resolved through good faith written negotiation within 14 days of the dispute being raised shall be submitted to binding arbitration in Maricopa County, Arizona before any litigation is initiated. The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorney fees and all associated legal costs from the non-prevailing party.

Section 7: Changes to These Terms

Scalefy LLC reserves the right to update or modify these Terms of Service at any time. When changes are made the updated terms will be posted on this page with a revised effective date. It is your responsibility to review these terms periodically.

Your continued use of our website or services after any changes are posted constitutes your acceptance of the updated terms. If you do not agree to the revised terms you must discontinue use of our services and notify us in writing at [email protected].
